Terms and Conditions

1. Definitions

  • “Company” means Joe Neill Fitness Ltd.

  • “Services” means gym access, coaching services, Small Group Personal Training (SGPT), trial programmes, memberships, and related products.

  • “Member” / “Client” means any individual using the Company’s Services.

  • “SGPT” means Small Group Personal Training delivered in a coached group format.

  • “Trial Period” means any fixed-term introductory SGPT trial, including the 6-Week SGPT Unlimited Trial.

 

2. Acceptance of Terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Services.

3. Services Offered

The Company provides gym facilities, coached training services, and related products. All Services are subject to availability and may be modified, substituted, or withdrawn at the Company’s discretion.

4. User Responsibilities

  • You must be 18 years of age or older to use the Services.

  • You are responsible for ensuring that you are medically fit to participate in physical exercise.

  • You must follow all gym rules, safety instructions, and coaching guidance at all times.

  • You agree to behave respectfully and lawfully while using the Services.

5. Refund Policy for Coaching Services

5.1 General Rule – No Refunds

All coaching services are non-refundable once commenced, except where expressly stated below. No refunds will be issued for unused sessions, missed sessions, early termination, or changes in personal circumstances.

5.2 SGPT One-Week Satisfaction Guarantee (Trial Period Only)

A full refund may be issued only where all of the following conditions are met:

  • A refund request is submitted within 7 calendar days of the client’s first SGPT session

  • The client has completed a minimum of three (3) SGPT sessions within that 7-day period

  • The client has complied with these Terms and all gym rules

5.3 Exclusions

  • This guarantee applies only during the SGPT Trial Period

  • It does not apply once the trial has ended or converted to a membership

  • It does not apply to open gym access, one-to-one personal training, online coaching, nutrition services, or retail products

  • Missed, cancelled, or rescheduled sessions do not count toward the 3-session requirement

5.4 Refund Processing

Approved refunds will be processed to the original payment method within 14 days.

6. Memberships and Cancellation

6.1 Ongoing Memberships

All memberships operate on a recurring monthly basis after the completion of any Trial Period, unless otherwise stated.

6.2 30-Day Cancellation Notice (Memberships Only)

Members on a recurring membership may cancel at any time by providing no less than 30 days’ written noticeexclusively via the Company’s online cancellation assistant:

Cancellation requests made verbally, in person, by email, or via social media will not be accepted.

  • The 30-day cancellation period does not apply during any SGPT Trial Period

  • Membership access will continue during the 30-day notice period

  • Any payments due within the notice period remain payable

  • No refunds or partial refunds will be issued for the notice period

6.3 Effective Date of Cancellation

Cancellation takes effect 30 days from the date the cancellation request is submitted, not from the next billing date unless the two coincide.

6.4 Suspension or Termination by the Company

The Company reserves the right to suspend or terminate access immediately in cases of:

  • Non-payment

  • Breach of gym rules

  • Conduct that endangers staff or other members

6.5 Refunds

Membership fees are non-refundable except where expressly stated in clause 5.2.

7. Trial Memberships and Recurring Charges

All SGPT trial memberships, including the 6-Week SGPT Unlimited Trial, are fixed-term commitments and are not subject to the 30-day cancellation policy.

Unless cancellation is submitted at least 7 days prior to the end of the Trial Period, the trial will automatically convert to the Standard Monthly Recurring Membership.

The Standard Monthly Membership is priced at £167 per month and allows access to up to three (3) SGPT sessions per week. By enrolling in a trial, you authorise recurring monthly charges unless cancellation is provided in accordance with these Terms.

8. Health, Safety and Assumption of Risk

Participation in physical exercise involves inherent risk. By using the Services, you acknowledge and accept these risks and agree that you participate voluntarily and at your own risk.

9. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

Subject to the above, the Company shall not be liable for any loss, injury, or damage arising from participation in the Services, except where required by law.

10. Intellectual Property

All content, materials, branding, and training resources provided by the Company remain its intellectual property and may not be reproduced, distributed, or shared without written permission.

11. Photography and Filming

By attending sessions or using the Services, you consent to photography and video recording for promotional purposes. You may withdraw consent at any time by contacting the Company.

12. Termination

The Company reserves the right to restrict or terminate Services for breaches of these Terms or inappropriate conduct.

13. Changes to Terms

The Company may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
